1. Acceptance of Terms

By downloading, installing, or using the Provyi mobile application ('App'), you agree to be bound by these Terms of Service ('Terms'). If you do not agree to these Terms, do not use the App.

These Terms apply to all users of the App, including requesters who create tasks and spotters who complete tasks.

2. Service Description

Provyi is a platform that connects requesters (individuals or businesses seeking surveillance services) with spotters (individuals who perform video recording tasks).

The App allows requesters to:

• Create surveillance tasks with specific locations and requirements
• Set payment amounts for completed tasks
• Review and approve submitted recordings
• Manage task status and communications

The App allows spotters to:

• Browse and accept available tasks
• Navigate to task locations using GPS
• Record videos according to task specifications
• Submit recordings for review and payment

3. User Accounts

3.1 Account Creation

• You must create an account to use the App
• You must provide accurate and complete information
• You are responsible for maintaining account security
• You must be at least 18 years old to create an account

3.2 Account Responsibilities

• You are responsible for all activities under your account
• You must notify us immediately of any unauthorized use
• You may not share your account credentials
• You may not create multiple accounts for fraudulent purposes

4. Requester Responsibilities

As a requester, you agree to:

• Provide accurate task descriptions and requirements
• Set reasonable payment amounts for tasks
• Review submitted recordings promptly and fairly
• Pay for approved tasks within the specified timeframe
• Not request illegal or inappropriate surveillance activities
• Respect spotters' time and effort
• Provide clear and specific task instructions

4.1 Task Creation Guidelines

• Tasks must be legal and ethical
• Tasks must not violate privacy laws
• Tasks must not involve harassment or stalking
• Tasks must be specific and achievable
• Payment amounts must be reasonable for the work required

4.2 Legal Compliance Requirements

• You are solely responsible for ensuring compliance with all applicable laws
• You must obtain necessary permits and consents for surveillance activities
• You must comply with local, state, and federal surveillance laws
• You must respect privacy rights and avoid illegal surveillance
• You acknowledge that Provyi does not provide legal advice

5. Spotter Responsibilities

As a spotter, you agree to:

• Complete accepted tasks to the best of your ability
• Follow task instructions accurately
• Submit recordings within the specified timeframe
• Maintain professional conduct during task completion
• Respect privacy and property rights
• Not engage in dangerous or illegal activities
• Provide accurate location and timing information

5.1 Recording Guidelines

• Recordings must be clear and of acceptable quality
• Recordings must follow the specified path and timing
• Recordings must not violate privacy laws
• Recordings must be submitted in the required format
• Recordings must be original work (not copied or edited)

6. Payment Terms

6.1 Payment Processing

• Payments are processed through Stripe
• Requesters must have sufficient funds for task payments
• Spotters must complete Stripe onboarding to receive payments
• Platform fees and commissions apply to all transactions

6.2 Payment Schedule

• Requesters pay when creating tasks
• Spotters receive payment after task approval
• Payments are processed within 2-3 business days
• Failed payments may result in task cancellation

6.3 Refunds and Disputes

• Refunds are processed according to our refund policy
• Disputes are resolved through our support system
• Second chance opportunities may be offered for rejected tasks
• Final decisions on task approval rest with requesters

7. Prohibited Activities

You may not use the App to:

• Engage in illegal surveillance activities
• Harass, stalk, or intimidate individuals
• Violate privacy laws or regulations
• Create tasks involving dangerous or harmful activities
• Submit false or misleading information
• Interfere with other users' tasks
• Attempt to defraud the platform or other users
• Use the App for commercial surveillance without proper authorization

8. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using the App, you consent to our Privacy Policy.

8.1 Location Data

• The App requires location access for navigation
• Location data is used only for task-related purposes
• Location data is stored securely and not shared unnecessarily
• You can control location permissions in your device settings

8.2 Media Content

• Recordings are stored securely
• Recordings are shared only between task participants
• Recordings may be retained for quality assurance
• You retain rights to your original recordings

9. Intellectual Property

9.1 App Content

• The App and its content are owned by Provyi
• You may not copy, modify, or distribute App content
• You may not reverse engineer the App

9.2 User Content

• You retain ownership of your recordings
• You grant us license to use content for service provision
• You are responsible for ensuring you have rights to share content

10. Service Availability

• We strive to maintain service availability but cannot guarantee 100% uptime
• We may perform maintenance that temporarily affects service
• We are not liable for service interruptions
• We will notify users of planned maintenance when possible

11. Limitation of Liability

To the maximum extent permitted by law, Provyi shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Damages arising from user disputes
• Damages from third-party services (Stripe, etc.)
• Damages from misuse of the App

Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Provyi from any claims, damages, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any laws or regulations
• Your interactions with other users

13. Termination

13.1 Account Termination

• You may delete your account at any time
• We may terminate accounts for Terms violations
• Termination does not affect completed transactions
• Outstanding payments must be settled before termination

13.2 Service Termination

• We may discontinue the service with notice
• We will process outstanding payments before discontinuation
• We will provide reasonable notice of service changes

14. Dispute Resolution

• Disputes will be resolved through our support system
• We encourage direct communication between users
• Legal disputes will be resolved in accordance with applicable law
• You agree to attempt resolution before legal action

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App. Your continued use of the App after changes constitutes acceptance of the updated Terms.

16. Legal Compliance and Surveillance Disclaimer

16.1 Surveillance Laws

• Surveillance activities are subject to strict legal regulations
• Users must comply with all applicable local, state, and federal laws
• Laws vary by jurisdiction and may require permits, licenses, or consent
• Users are responsible for understanding and following all relevant laws

16.2 User Responsibility

• You acknowledge that you are solely responsible for legal compliance
• Provyi does not verify the legality of surveillance activities
• You must obtain all necessary permissions and consents
• You must not use the App for illegal surveillance or harassment

16.3 Business Use Only

• This App is intended for legitimate business purposes only
• Acceptable uses include: property monitoring, security verification, business documentation
• Prohibited uses include: stalking, harassment, invasion of privacy, illegal surveillance

16.4 No Legal Advice

• Provyi does not provide legal advice
• Users should consult with legal professionals regarding surveillance laws
• We recommend understanding local laws before using surveillance features

17. Governing Law

These Terms are governed by the laws of the jurisdiction where Provyi is incorporated. Any disputes will be resolved in the appropriate courts of that jurisdiction.
